These Terms of Use ("Terms") govern your use of the Titer mobile application ("Titer," "the app," "we," "us"). By downloading or using Titer you agree to these Terms. If you do not agree, do not use the app.
Handling, reconstituting, measuring, and administering substances carries inherent risks. These risks include the possibility of serious injury, illness, or death, including harm caused by incorrect entries, incorrect calculations, product contamination, or adverse reactions. In particular, if any calculation, entry, or display in Titer is wrong for any reason and you draw or take a larger or smaller dose than intended without independently verifying it, that outcome is part of the risk you accept. You acknowledge and accept those risks, and agree that you use Titer and any information it produces entirely at your own risk.
You must be at least 18 years old and legally permitted to use the app where you live. You are responsible for complying with all laws applicable to any substance you track. By using Titer you represent that you meet these requirements.
Titer offers optional auto-renewing subscriptions. Current prices and the length of each subscription period, monthly or annual, are shown in the app before you subscribe. Payment is charged to your Apple ID at confirmation of purchase and renews automatically unless canceled at least 24 hours before the period ends. Manage or cancel in your Apple ID settings. All billing and refunds are handled by Apple; we do not process or store payment information and cannot issue refunds directly. To request a refund, use Apple's process at reportaproblem.apple.com or contact Apple Support. If a subscription price changes, Apple will notify you in advance and, where required, ask you to agree before the new price takes effect.
Titer stores what you enter on your device. We do not collect it. See our Privacy Policy.
Titer is provided "as is" and "as available," without warranties of any kind, express or implied, including accuracy, fitness for a particular purpose, reliability, or availability. We do not warrant that the app or any calculation is accurate, complete, error-free, or uninterrupted. Reminders and schedules are conveniences, not safeguards. Notifications can be delayed or fail to appear, and data can be lost if your device is lost or damaged. Do not rely on Titer as your only way of remembering or recording any dose.
To the fullest extent permitted by law, in no event shall the developer be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, loss of profits, personal injury, or loss of health, arising out of or relating to your use of (or inability to use) Titer or any information it produces, even if advised of the possibility of such damages. Our total aggregate liability for any claim will not exceed the greater of the amount you paid us in the prior twelve months or USD $50. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.
You agree to indemnify and hold the developer harmless from any claims, damages, or expenses, including reasonable attorneys' fees, arising out of your misuse of the app, your violation of these Terms, or your violation of any law or the rights of any third party.
We grant you a personal, non-exclusive, non-transferable, revocable license to use Titer on Apple-branded devices you own or control, as permitted by the App Store terms. Titer, including its code, design, calculations, and name, belongs to the developer and is protected by intellectual-property law. You may not copy, modify, distribute, sell, rent, or sublicense any part of the app, and you may not reverse engineer, decompile, or attempt to extract its source code, except to the extent the law allows it despite this restriction.
Titer is distributed through the Apple App Store. These Terms incorporate, at minimum, Apple's standard Licensed Application End User License Agreement. Apple is not a party to these Terms, has no obligation to provide maintenance or support for the app, and is not responsible for addressing any claims relating to it; Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. If these Terms conflict with Apple's standard EULA, these Terms control to the extent Apple's terms allow.
You may stop using Titer at any time by deleting the app. Your license to use the app ends automatically if you materially violate these Terms. Any provision that by its nature should survive termination does, including the medical disclaimer, assumption of risk, license restrictions, warranty disclaimer, limitation of liability, indemnification, and the governing-law and dispute provisions.
These Terms are governed by the laws of the State of Texas, United States, without regard to conflict-of-laws principles. Any dispute arising out of these Terms or your use of Titer will be brought in the state or federal courts located in Texas, and you consent to their jurisdiction, except where the law of your state gives you the right to bring a claim elsewhere. Before filing any claim, you agree to email us at the address in Section 15 describing the dispute and to give us 30 days to resolve it informally. Either of us may bring a qualifying individual claim in small claims court instead. To the extent permitted by law, you and the developer each waive the right to a jury trial and the right to participate in a class action or other representative proceeding. Disputes may be brought only on an individual basis. If the class waiver is held unenforceable for a particular dispute, it is severed for that dispute only.
If any provision of these Terms is held unenforceable, the remaining provisions stay in full effect. Our failure to enforce a provision is not a waiver of it. You may not assign or transfer these Terms. We may assign them, including to a company we form or to a successor to the app, and they bind and benefit any permitted successor. These Terms, together with the Privacy Policy, are the entire agreement between you and us regarding Titer.
We may change, suspend, or discontinue any feature of Titer, or the app itself, at any time without liability to you. Refunds for any active subscription remain governed by Apple's policies. We may update these Terms; the date above reflects material changes. If a change materially reduces your rights, we will take reasonable steps to notify you, such as a notice in the app or on this page, before it takes effect. Continued use after changes means you accept them.
